This Act shall be known as the Act for the Facilitationand Regulation of International Disaster Relief and InitialRecovery Assistance.b. This Act may also be cited as the International DisasterAssistance Act of［YEAR］.第1条簡略名称a.この法律は、「国際的な災害救援及び初期復興支援の円滑化及び規制のための法律」と称する。b.この法律は、［○○年］の「国際災害支援法」として引用されることもある。Article 2 Purpose and Scope of the Acta. This Act［implements Articles *** of the Constitutionof country name.］It is based on the understanding that［country name/states/territories］bears［bear］the primaryresponsibility to respond to Disasters on its［/their］territory, but that International Disaster Assistance maysometimes be required to supplement domestic efforts.b. This Act sets out procedures, roles and responsibilitiesrelated to the facilitation and regulation of InternationalDisaster Assistance provided to［country name］in theevent of a Disaster on its territory, as well as forInternational Disaster Assistance transiting through［country name］’s territory to aid another affected state.c. In particular, this Act:（i）sets out roles and responsibilities for keyministries and departments concerned with thefacilitation and regulation of InternationalDisaster Assistance;（ii）establishes procedures for initiating,coordinating, and terminating InternationalDisaster Assistance;（iii）establishes the mechanism for recognition ofeligibility for Legal Facilities for certain AssistingActors;（iv）specifies the Legal Facilities to be providedto such Eligible Actors;（v）specifies that minimum standards areexpected from Assisting Actors providingInternational Disaster Assistance; and（vi）facilitates the transit of International Disaster第2条目的及び範囲a.この法律は、［国名の憲法第***条を実施するものである。］この法律は、［国名/州/領域］がその領域における災害に対応する第一義的責任を負うものの、国内における取組を補完するために国際的な災害支援が必要な場合があるという理解に基づくものである。b.この法律は、［国名］の領域における災害の発生において［国名］に提供される国際的な災害支援、及び他の被災国を支援するために［国名］の領域を通過する国際的な災害支援の円滑化及び規制に関連する手続、役割及び責任を定めるものである。c.特に、この法律は、次のことを目的とする。（i）国際的な災害支援の円滑化及び規制に関連した主要な省庁及び部署の役割及び責任を定める。（ii）国際的な災害支援の開始、調整及び終了のための手続を制定する。（iii）特定の支援主体に対する法的便宜の授与資格の認定のため制度を制定する。（iv）授与資格を有する主体に与えられる法的便宜を特定する。（v）国際的な災害支援を提供する支援主体には最低基準が求められることを明示する。（vi）被災したその他の国に対する国際的な災人道研究ジャーナルVol. 3, 2014 161
