The provisions of this Act do not apply to situations ofarmed conflict or to Disasters that occur in an area of［country name］also affected by an armed conflict.International assistance provided in those circumstancesis governed by［International Humanitarian Law or ActImplementing the Geneva Conventions］.害支援の通過を円滑にする。d.この法律の条項は、武力紛争の状況又は武力紛争の影響を受けた［国名］の地域で発生する災害に適用されない。それらの状況において提供される国際的な支援は、［国際人道法又はジュネーブ条約の実施法］によって統制される。Article 3 DefinitionsFor the purposes of this Act:“Assisting Actor”means any Assisting InternationalActor and any Assisting Domestic Actor responding to aDisaster in［country name］.“Assisting Domestic Actor”means any not-for-profitentity established under the laws of［country name］,which is responding to a Disaster in the territory of［country name］.“Assisting International Actor”means any foreignstate, organization, entity or individual responding to aDisaster on the territory of［country name］or transitingthrough the territory of［country name］to respond to aDisaster in another country.“Assisting State”means any foreign government that isproviding Disaster Relief or Initial Recovery Assistanceto［country name］, whether through its civilian ormilitary institutions.“Disaster”［is defined as set out in Article *** of the［national disaster management act］［or means a seriousdisruption of the functioning of society, which poses asignificant, widespread threat to human life, health,property or the environment, whether arising fromaccident, nature, or human activity, whether developingsuddenly or as the result of long-term processes, butexcluding armed conflict.］“Disaster Relief”means the Goods, Equipment, Servicesand Internationally Donated Funds provided to meet theimmediate humanitarian needs of Disaster-affectedcommunities, including rescue.“Domestic Non-Governmental Organization”or“Domestic NGO”means any non-governmental, notfor-profitentity, which has its headquarters in［countryname］and whose mandate and activities are focused onhumanitarian relief, recovery or development.第3条定義この法律の適用上、「支援主体」とは、［国名］における災害に対応する国際的な支援主体及び国内の支援主体をいう。「国内の支援主体」とは、［国名］の法律の下で設立され、［国名］の領域における災害に対応している非営利団体をいう。「国際的な支援主体」とは、［国名］の領域における災害に対応する、又は他の国における災害に対応するために［国名］の領域を通過する外国の国家、組織、団体又は個人をいう。「支援国」とは、［国名］に対して文民又は軍の組織による災害救援又は初期復興支援を提供している外国の政府をいう。「災害」とは、［国内災害管理法第***条に定める通り定義される。］［又は、事故、自然又は人的活動のいずれによって引き起こされるかを問わず、突発的に又は長期的経過の結果として発生するかを問わず、人間の生命、健康、財産又は環境に対する重大かつ広範な脅威をもたらす社会機能の深刻な混乱（ただし、武力紛争を除く。）をいう。］「災害救援」とは、被災コミュニティの緊急の人道的なニーズ（救助を含む。）を満たすために提供される物資、機材、サービス及び国際的に寄付された資金をいう。「国内の非政府組織」又は「国内NGO」とは、［国名］に本部を置く非政府、非営利団体で、その職務及び活動が人道的救援、復興又は開発を対象とするものをいう。162人道研究ジャーナルVol. 3, 2014
