The Journal of Humanitarian Studies Vol. 3, 2014［relevant disaster management authority］shall provideAssisting Actors described in subsection（a）a certificateof eligibility, upon their request.にするため、支援主体からの要請に応じ、a項に示す授与資格の証明書をこれらの主体に提供する。Article 22 Application for Eligibility for LegalFacilities by Assisting Actorsa. With the exception of those deemed eligible pursuantto Article 21, Assisting Actors seeking eligibility shallapply in accordance with this Article. AssistingInternational Actors may apply only if they arerecognized as a legal person in a foreign country or underinternational law.b. The eligibility of private businesses for Legal Facilitiesshall be limited to assistance from which they make noprofit or other commercial gain.c. Applications for eligibility may be made in advance ofany Disaster, or after the onset of a Disaster. In the eventthat eligibility for Legal Facilities is granted in advanceof a Disaster, it will remain valid for［5 years］, afterwhich a new application is required. The Legal Facilitieswill enter into legal effect only during an InternationalDisaster Relief or Initial Recovery Period.d. All Assisting Actors seeking eligibility shall submit:（i）certified copies of documents evidencingtheir legal personality in a foreign jurisdiction orunder international law, in the case of AssistingInternational Actors, or under the laws of［countryname］, in the case of Assisting Domestic Actors;（ii）the name and full contact details of theauthorized representative of the organization andthe address of its headquarters, if any, in［countryname］;（iii）documentation relating to their previousexperience and current capacity in providingeffective Disaster Relief or Initial RecoveryAssistance;（iv）documentation of adequate liabilityinsurance; and（v）a n u n d e r t a k i n g r e l a t i n g t o t h e i rorganizational commitment and practicesconcerning the responsibilities set out in ChapterIV.第22条支援主体による法的便宜の授与資格の申請a.授与資格を求める支援主体は、第21条に従って授与資格を有するとみなされる支援主体を除き、本条に従って申請手続を行う。国際的な支援主体は、外国において又は国際法の下で法人と認められている場合にのみ申請できる。b.民間企業の法的便宜の授与資格は、利益又はその他の営利を得ることのない支援に限られる。c.授与資格の申請は、災害の発生以前又はそれ以降に行うことができる。災害に先立って法的便宜の授与資格が承認された場合には、当該資格は［5年間］有効であり、その後は新たな申請が必要となる。法的便宜は、国際的な災害救援又は初期復興支援期間においてのみ法的に有効となる。d.授与資格を求める支援主体は、次の書類を提出する。（i）国際的な支援主体の場合には、外国の管轄における又は国際法の下での法人格を証明する書類の謄本。国内の支援主体の場合には、［国名］の法律の下での法人格を証明する書類の謄本。（ii）組織の公式代表者の氏名及び詳細な連絡先、並びに［国名］における本部の所在地（該当する場合）（iii）実効的な災害救援又は初期復興支援の提供における過去の実績及び現在の能力に関する書類（iv）適切な賠償責任保険の書類（v）第4章に定める責任に関する組織としての誓約及び実践に関する保証Article 23 Eligibility Determination and第23条授与資格の認定及び証明書人道研究ジャーナルVol. 3, 2014 177
