The Journal of Humanitarian Studies Vol. 3, 2014Article 35 Inspections and Customs SecurityDuring the International Disaster Relief Period only, the［customs authority］shall:a. on the basis of risk analysis, take only such action as itdeems essential to ensure compliance with customs andrelated laws for the purpose of checking the goodsdeclaration of a consignment sent by or on behalf ofEligible Actors;b. use risk analysis, preferably on the basis of advanceinformation, to determine which consignments of Goodsand Equipment imported by or on behalf of EligibleActors shall be inspected and the extent of thatinspection; andc. waive, as feasible, any customs security that wouldnormally be required in respect of consignments ofGoods and Equipment imported by or on behalf ofEligible Actors. However, if, in an exceptional case,customs security is deemed necessary, it shall accept assecurity an undertaking from the relevant Eligible Actoror, where appropriate, a general customs security.第35条検査及び通関保証［税関当局］は、国際的な災害救援期間においてのみ、a.リスク分析に基づき、授与資格を有する主体（又はその代理）によって送付される積荷の申告を点検する目的で通関及び関連法の遵守を確保するために必須であるとみなされる行動のみをとる。b.授与資格を有する主体（又はその代理）によって輸入される物資及び機材のいずれの積荷を検査するかについて並びに当該検査の度合いを決定するため、可能であれば、事前情報を基にリスク分析を適用する。c.授与資格を有する主体（又はその代理）によって輸入される物資及び機材の積荷に関し、通常であれば必要とされる通関保証を可能な限り免除する。ただし、例外として通関保証が必要であるとみなされた場合には、関係する授与資格を有する主体からの保証を安全なものとして受け入れ、又は、適切な場合には、一般的な通関保証を受け入れる。Article 36 Agreements on Pre-Positioning of StockThe［relevant authority］may enter into an agreementwith an Eligible Actor to extend the relevant LegalFacilities of this Part to pre-positioning of stocks in［country name］, in preparation for potential Disaster, orafter a specific Disaster warning.第36条備蓄の事前配備に関する協定［関係当局］は、潜在的な災害に対する準備のために又は特定の災害警報が発せられた後に、本節の関係する法的便宜を［国名］における備蓄の事前配備に適用するため、授与資格を有する主体と協定を結ぶことができる。Part 3 Expedited Entry and Use Restrictions forSpecific International Disaster Goods andEquipment第3節特定の国際的な災害物資及び機材に対する迅速な入国及び使用の制限Article 37 Telecommunications Equipmenta. Eligible Actors shall be permitted to importtelecommunications Equipment for the purpose ofDisaster Relief or Initial Recovery Assistance withoutrestrictions, except as required for purposes of nationalsecurity or public order.b. Upon notification of the names, frequencies, asapplicable, and locations of intended use of suchtelecommunications Equipment imported by EligibleActors, the［relevant telecommunications authority］shallwaive any licensing requirements or fees for their use.第37条通信機材a.授与資格を有する主体は、国家の安全又は公的秩序に必要な場合を除き、災害救援又は初期復興支援の目的のため、制限なく通信機材を輸入することを許可される。b.［関係通信当局］は、授与資格を有する主体によって輸入される通信機材の名称、該当する場合は周波数、及び予定された使用位置の通知をもって、使用に関する免許要件又は料金を免除する。人道研究ジャーナルVol. 3, 2014 183
