The Journal of Humanitarian Studies Vol. 3, 2014Part 5 Transport第5節輸送Article 45 Facilitation of Means of TransportGround, air and water transport vehicles operated by oron behalf of Eligible Actors to transport International andLocally Engaged Personnel, Goods, or Equipment for thepurposes of Disaster Relief or Initial Recovery Assistanceshall be:a. accorded priority treatment for passage, including, asappropriate, priority in air traffic routing and landingpermissions;b. exempt from any applicable taxes, levies, duties, feesor charges normally imposed by governmental entities of［country name］, including, but not limited to:（i）overflight, landing, parking, taking off andnavigation service fees;（ii）demurrage and docking fees; and（iii）road tolls; andc. exempt from any prohibitions, limitations orrestrictions in respect of their arrival, overflight, landing,stay and departure, other than those necessary toguarantee national security, public safety or public health.第45条輸送手段の円滑化災害救援又は初期復興支援の目的で授与資格を有する主体（又はその代理）によって国際要員及び現地雇用要員、物資又は機材を輸送するために運行される陸上、航空及び海上の輸送機器は、a.通過のための優先的待遇を与えられる（必要に応じ、航空交通経路及び着陸許可での優先的待遇を含む。）。b.下記のものを含め（ただし、これらに限定されない。）、［国名］の政府機関によって通常は課せられる適用される諸税、関税、料金又は手数料を免除される。（i）領空飛行、着陸、駐機、離陸及び航空管制に関する料金（ii）滞船料及び入渠料（iii）道路通行料金c.国家の安全、公共の安全及び公衆衛生を確保するために必要なものを除き、到着、領空飛行、着陸、滞在及び出発に関する禁止、制限又は制約から免除される。Article 46 Entry of Transport OperatorsThe［relevant authorities］shall endeavour to reduce andexpedite any procedures for the entry of drivers, pilotsand crew of Transport vehicles operated by or on behalfof Eligible Actors.第46条輸送機器操縦者の入国［関係当局］は、授与資格を有する主体（又は代理）によって運行される輸送機器の運転手、パイロット及び乗組員の入国手続を軽減し及び迅速に行うよう努める。Article 47 Notice of TransportTo facilitate the provision of the Legal Facilities in thisPart, Eligible Actors or their carriers shall:a. inform the［relevant aviation authority］in advance ofthe intended route of flights, type and call signs of theaircraft, number of crew members, the character of thecargo, time-table of flights, and the list of all passengers,and shall comply with any directions from the［relevantaviation authority］as to air traffic control and landingprocedures; andb. inform the［relevant marine authority］in advance, ofthe intended port or location of arrival of each watervessel, the type, make and registration number of eachvessel, the number of personnel operating and on boardeach vessel and the equipment, facilities and other第47条輸送に関する通知授与資格を有する主体又は輸送業者は、本節における法的便宜の提供を円滑にするため、a.［関係航空当局］に対し、予定航空経路、航空機の型番及びコールサイン、乗組員の人数、積荷の特徴、飛行予定時刻、並びにすべての乗客のリストを事前に通知することとし、［関係航空当局］からの航空管制及び着陸手続に関する指示に従う。b.［関係海上当局］に対し、各海上輸送機器の予定到着港又は地点、船種、製造及び登録番号、乗組員及び乗員の人数、機材、施設及びその他の器具に関する情報を事前に通知することとし、［関係当局］の入港管制又はドッキング手続に関する指示に従う。人道研究ジャーナルVol. 3, 2014 187
