To facilitate the［relevant disaster managementauthority’s or ombudsman’］oversight, it may requireAssisting Actors to report to it, at reasonable intervals,about the Disaster Relief and Initial Recovery Assistancethey provide. These reports shall be made publiclyavailable［through electronic means］.c. Any reporting requirements imposed by the［relevantdisaster management authority or ombudsman］underthis Article shall be designed so as to reduce anyadministrative burden on Assisting Actors to theminimum necessary.b.［関係災害管理当局又はオンブズマン］は、その監督を円滑にするため、支援主体に対して適度な期間ごとに自らが提供する災害救援及び初期復興支援に関する報告を求めることがある。これらの報告書は、［電子的に］公開される。c.本条の下で［関係災害管理当局又はオンブズマン］によって課せられる報告要件は、支援主体の事務的な負担を最低限に抑えるよう設定される。Article 57 Non-Compliance by Assisting Actorsa. If, on the basis of information it deems credible, the［re l e v a n t d i s a s t e r m a n a g e m e n t a u t h o r i t y o rombudsman］suspects that any Assisting Actor has failedto materially comply with its responsibilities under thisAct, and in particular its responsibilities under ChapterIV, it shall immediately consult with the Assisting Actorand seek clarification or explanation. If still unsatisfied,the［relevant disaster management authority orombudsman］shall provide written notice of noncompliancealong with a decision either:（i）to require the Assisting Actor to bring itselfinto compliance within a specified period of time,with or without temporary suspension of itseligibility, if any, for Legal Facilities underChapter VI;（ii）to revoke the Assisting Actor’s eligibility, ifany, for Legal Facilities under Chapter VI;（iii）in the case of deliberate misrepresentation orfraud, to impose fines to be set out byimplementing regulation; or（iv）in the most extreme cases concerning anAssisting International Actor, to revoke［countryname’s］consent for it to provide Disaster Reliefor Initial Recovery Assistance in response to theDisaster.b. In the event of a decision to revoke pursuant tosubsection（a）（iv）of this Article, if the AssistingInternational Actor lacks a legal basis independent of thisAct to remain in the country, it may be required to depart,as of a date no sooner than［30］days from the date of thenotice.第57条支援主体による遵守違反a.［関係災害管理当局又はオンブズマン］は、信憑性があるとみなす情報に基づき支援主体がこの法律及び特に第4章の下での義務への遵守を著しく怠ったと疑う場合には、直ちに当該支援主体と協議を行い、説明又は釈明を求める。［関係災害管理当局又はオンブズマン］は、納得できない場合には、書面による遵守違反の通知を次のいずれかの決定とともに送付する。（i）特定の期間内に支援主体が遵守するよう求める（該当する場合には、第6章の下での法的便宜の授与資格の一時的な停止を伴うこともある）。（ii）該当する場合には、支援主体の第6章の下での支援主体の法的便宜の授与資格を取り消す。（iii）故意の詐称又は詐欺の場合には、実施規則に定める罰金を課す。（iv）国際的な支援主体に関する最も深刻な事案の場合には、当該支援主体が災害に対応して災害救援又は初期復興支援を提供することに対する［国名］の同意を取り消す。b.本条のa項（iv）に従って取り消す決定がなされた場合には、国際的な支援主体が国内に滞在するためにこの法律以外の法的根拠を欠く場合には、通知の日から［30］日以内に出国することが求められる。192人道研究ジャーナルVol. 3, 2014
